Terms and Conditions – Rowan Toronto

Welcome to Rowan Toronto. These Terms and Conditions outline the rules and regulations for the use of our website and the purchase of our products. By accessing this site and/or placing an order, you agree to be bound by these Terms. Please read them carefully.


Article 1 – Definitions

In these Terms and Conditions, the following definitions apply:

  • Withdrawal Period: The period during which the consumer may exercise their right of withdrawal.

  • Consumer: Any natural person not acting in the course of a profession or business who enters into a distance contract with the entrepreneur.

  • Ongoing Contract: A distance contract relating to a series of products or services with obligations spread over time.

  • Right of Withdrawal: The consumer’s right to withdraw from the distance contract within the withdrawal period.

  • Entrepreneur: The natural or legal person offering products or services remotely to consumers.

  • Distance Contract: A contract concluded between the entrepreneur and the consumer using remote communication methods.

  • CESOP: The Central Electronic System of Payment Information introduced by the EU to monitor payment service providers.

Article 3 – Applicability

These Terms and Conditions apply to every offer from the entrepreneur and to every distance contract concluded. Before the agreement is finalized, these Terms will be made available electronically or otherwise.


Article 4 – The Offer

  • Offers are non-binding. The entrepreneur reserves the right to modify offers.

  • Each offer clearly states the total cost, including shipping, customs duties, and any other charges imposed by the postal or courier service.

  • If an offer is valid for a limited time or subject to specific conditions, this will be explicitly stated.


Article 5 – The Contract

The contract is concluded when the consumer accepts the offer and meets the stated conditions. The entrepreneur will confirm acceptance immediately by email.


Article 6 – Right of Withdrawal

Consumers have the right to withdraw from the contract within 30 days of receiving the product, without providing any reason.
Return shipping costs are the responsibility of the consumer when exercising the right of withdrawal.


Article 7 – Costs in Case of Withdrawal

The entrepreneur will refund payments within 14 days of withdrawal, provided the product is returned in its original condition.
If the consumer exercises the right of withdrawal, the costs of returning products are entirely at the consumer’s expense. These costs include return to the country of origin, which may be outside the consumer’s country (e.g., China).


Article 8 – Customs Regulations and VAT

  • The customer is solely responsible for complying with all legal obligations regarding the importation of goods into the delivery country, including but not limited to import duties, taxes, and customs clearance fees.

  • The entrepreneur does not act as the importer of the goods shipped to the customer.

  • The customer must ensure compliance with local import laws and regulations.

  • Any additional charges incurred during customs clearance, including administrative fees by postal or courier services, are the sole responsibility of the customer.

  • The entrepreneur provides the necessary documentation for shipping but does not guarantee compliance with local import regulations. Customers are advised to verify import requirements before ordering.


Article 9 – CESOP Compliance

As of 2024, payment service providers will report transaction data to CESOP (Central Electronic System of Payment Information) as per EU regulations. The entrepreneur complies with these regulations, which may affect the monitoring and reporting of payments.


Article 10 – Compliance and Warranty

The entrepreneur guarantees that products conform to the contract and legal requirements.
Claims regarding defects must be submitted in writing within 14 days.
Products must be returned in their original packaging and condition.


Article 11 – Delivery

Orders will be delivered within 30 days unless otherwise agreed.
In case of delay, the entrepreneur will inform the consumer within 14 days of the order date.
Orders are shipped under conditions making the customer the recipient and responsible party for import procedures.
The entrepreneur ensures that products are shipped in accordance with international shipping regulations but accepts no liability for delays or issues during customs clearance.
Failure by the customer to comply with import obligations is not grounds for order cancellation or refund.


Article 12 – Return Policy

Returned products must be in their original condition and packaging and accompanied by proof of purchase.
Returns are accepted only within 30 days of receipt by the customer.
Customers must contact customer service before returning any product to obtain return instructions.
Return shipping costs are the responsibility of the customer unless due to an error by the entrepreneur.
In case of partial returns, original shipping fees are non-refundable.


Article 13 – Complaint Resolution

Complaints must be submitted in writing within 7 days of discovering the issue.
The entrepreneur will respond within 14 days. If more time is needed, an estimated resolution time will be provided.


Article 14 – Disputes

These Terms and Conditions are governed by Dutch law.
Disputes will first be resolved amicably. If necessary, disputes will be submitted to the competent court in the Netherlands.
